ACCEPTANCE OF TERMS OF SERVICE
These terms of service are entered into by and between you (“Traveler”, “you”) and Indoneo (“Indoneo”, “we” or “us”). The following Terms Of Service, together with any documents they expressly incorporate by reference (collectively, these “Terms Of Service”), govern your access to and use of www.indoneo.com and associated domains, including any content, functionality and services offered on or through www.indoneo.com (the “Website”). Please read the Terms Of Service carefully before you start to use the Website. By using the Website or by clicking to accept or agree to the Terms Of Service when this option is made available to you, you accept and agree to be bound and abide by these Terms Of Service. If you do not want to agree to these Terms Of Service you must not access or use the Website.
TRAVEL SERVICES AGREEMENT
The purchase/payment of any travel services offered by Indoneo constitutes a contractual arrangement between the Traveler and Indoneo, and indicates that you and all members of your travelling party have read and accepted these Terms Of Service. As the lead traveler, you accept, and confirm you have authority and consent to accept, these Indoneo Terms Of Service for yourself and all members of your traveling party. Your booking is not confirmed until your payment is processed by Indoneo and you receive a confirmation invoice.
DEPOSIT
10% of the tour total price is required as non-refundable, non-transferable deposit to reserve space for you. If the Traveler pays the full value of the tour at once, 10% of the full payment is considered as the deposit.
PREPAYMENT
Minimum 50% of the tour total price is due 45 days prior to commencement of services. Hotel and flight tickets arrangements may require an additional prepayment.
FINAL PAYMENT
Final full payment for your tour is due 30 days prior to commencement of services. Reservations (transport, hotel, flights, etc) may be canceled if the final payment is not received by the due date; cancellation penalties may apply, as noted below. Delayed payments may lead to increased tour price and re-invoicing, as Indoneo cannot guarantee the previously agreed prices for accommodation, flights, ground transport, etc.
INVOICING
You are responsible for verifying everything on your invoice is accurate and complete, including dates of travel, options selected, and that each traveler matches the relevant passport or government issued ID used for travel. Indoneo cannot accept responsibility if we are not notified of inaccuracies within 5 days of sending out the invoice. In the case of billing errors, Indoneo reserves the right to re-invoice you with correct pricing.
BOOKING CANCELLATIONS AND FEES
If a booking cancellation is received by Indoneo prior to the final payment date of your tour, your non-refundable deposit will be retained. If you must cancel before departure, money will be returned less the Standard Cancellation Fees plus any additional payments already advanced to airlines, hotels and local operators.
STANDARD CANCELLATION FEES
The following cancellations are applicable to all tours unless otherwise noted.
- – 30-22 days prior to commencement of services: 20% of total price
- – 21-8 days prior to commencement of services: 30% of total price
- – 7-1 days prior to commencement of services: 50% of total price
- – On departure day and later: 100% of total price
FLIGHTS ARRANGEMENTS
Flight tickets may be purchased through Indoneo. All carriers are independent operators and are not owned, managed, or operated by Indoneo. Your airline ticket is a contract between you and the air carrier only, even if you purchase through Indoneo. By purchasing your air services through Indoneo, you waive all liability for Indoneo for such air services. Indoneo is not responsible if an airline cancels, reschedules, or delays a flight for any reason. If you purchased air through Indoneo, we will try to assist in making new arrangements, provided you have not already checked in with your airline for your first flight segment. After check-in, you must work with the airline directly to reach your destination or to make any alternate arrangements, including amendments to return services. Airline fees often apply for modifications to air schedules not related to airline-imposed flight cancellations, reschedules, or delays. These fees will be payable to the airline directly.
OPTIONAL ACTIVITIES
Optional activities (“the Services”) available for booking are provided by local operators or other third parties that are entirely independent of Indoneo and do not form any part of the product or services sold to you by Indoneo or of these Terms Of Service, even where Indoneo suggests particular operators/other third parties and/or assists you in booking such optional excursions. Your contract for such Services will be with the organizer or operator of that Service, and will be subject to its Terms Of Service, which may contain exclusions or limitations of liability. Indoneo has no liability for any such optional excursion or for any act(s) or omission(s) of the organizer or operator or for any of its employees or agents or any other person(s) connected with the optional excursion.
BAGGAGE
No responsibility is accepted by Indoneo for loss of or damage to baggage or any of the traveler’s belongings throughout the duration of the tour. Travelers are strongly encouraged to not bring valuables or large amounts of cash. Any such valuables should not be left in baggage out of the control of the traveler. Baggage insurance is recommended.
YOUNG TRAVELERS
Travelers who are under 18 years old on the departure date must be accompanied by an adult throughout the tour and are requested to share an adult’s accommodation. If you are traveling with children, you are solely responsible for their behavior and monitoring them throughout the tour.
FORCE MAJEURE
Indoneo assumes no liability for any loss, damage, personal injury or loss of life resulting from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, or any other unforeseen circumstances or any other factors unforeseen by Indoneo that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, Indoneo shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind. Indoneo accepts no responsibility for personal injury or loss of life resulting from such conditions, and offers no compensation.
ACCEPTANCE OF RISK
You acknowledge that the nature of the tour is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. It is your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
Be aware that during your participation on tours operated by Indoneo, certain risks and dangers may arise beyond our control, including, but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities. Indoneo will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. While Indoneo will use its best efforts to ensure that adequate measures are taken, by agreeing to participate in a tour and/or optional excursions you agree that you will hold Indoneo harmless regarding any provision of medical care or the adequacy of any care rendered. Indoneo is not responsible for such risks and dangers that may arise beyond our control. Payment of your deposit indicates you accept these risks and dangers and agree to hold Indoneo harmless for such.
LIMITATION OF LIABILITY
We contract with a network of companies, government agencies and individuals to assist in the running of our tours as agent for these third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
– any liability for any loss, death, injury or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a tour, or any breach of the Terms Of Service, is excluded;
– you release us and our officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a tour; and
– any condition or warranty which would otherwise be implied by law into these Terms Of Service, is excluded.
To the extent an implied warranty cannot be excluded, our liability in respect of the implied warranty is limited to (in our absolute discretion): (i) the provision of a similar tour to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking minus the amount already used to pay for flights, transport and accommodation reservations.
Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special or punitive damages.
MEDICAL & HEALTH
Indoneo recommends that all passengers be in good health to ensure the smooth operation of your travel plans. Please check your health status and discuss your suitability for long distance travel with your doctor. If you require any special consideration for physical or mental ill health, please state this when ordering. Indoneo does not employ medical personnel. Any medical attention you require while traveling with Indoneo must be sought through a local medical facility, if/when available, for diagnosis. All related charges are at your expense. Indoneo cannot guarantee the availability of medical facilities or for the quality of the care or services.
TRAVEL INSURANCE
Travel insurance is mandatory for all our travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$100,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company’s 24 hour emergency contact number on the first day of your trip.
PASSPORTS AND VISAS
Travelers are expected to obtain visas for all countries on their itinerary, and to carry the necessary travel documents. Different nationalities have different requirements for different countries, and Travelers are expected to understand these policies. Indoneo does not accept responsibility for passengers failing to obtain the correct documents for entry or passage. Travelers must bear the cost for delays or cancellations resulting from their failure to obtain the correct travel documents. Indoneo does not accept any responsibility for penalties resulting from failure to comply with national laws or government regulations.
AUTHORITY ON TOUR
Our group trips are run by a Tour Leader. The decision of the Tour Leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a Tour Leader, or interfere with the well-being or mobility of the group, the Tour Leader may direct you to leave the trip immediately, with no right of refund.
TRAVELERS WHO NEED SPECIAL ASSISTANCE
You must report to Indoneo any disability requiring special attention while on tour at the time the reservation is made. Indoneo will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so nor responsible for any denial of services by air carriers, hotels, restaurants, or other independent suppliers. Indoneo does not provide personal services (such as pushing a wheelchair, assisting with walking, etc.) and Indoneo does not provide individual assistance to a tour participant. A qualified and physically-able companion should accompany travelers who need such assistance.
If we are not notified at the time of reservation of any disability requiring special attention, Indoneo reserves the right to cancel your booking or terminate your tour if your special needs or disabilities are not suitable for the tour, pose a threat to the health and safety of other participants or Indoneo staff, are incompatible with other travelers, or if you are not traveling with a companion who provides all the assistance you require. Indoneo will not refund or cover any costs or expenses incurred for cancellation, booking, or termination of the tour. Cancellation penalties, as above, apply.
Not all sightseeing stops/sites accommodate wheelchairs, and some locations and sightseeing activities require extensive standing, sitting, or walking—sometimes on unpaved or cobblestone streets. Indoneo will not refund or cover any cost or expenses incurred for any missed activities due to a participant’s inability to fully participate with the group. Most transportation services, including the touring buses, are not equipped with wheelchair ramps.
Dietary requests and preferences must be provided to Indoneo at the time of booking. Generally, special dietary or meal requests cannot be processed and are subject to availability at the hotel or venue. There is no guarantee of availability, however, and there may be an additional charge associated with such requests, which is payable by you at the time of service.
TOUR CANCELLATIONS
Indoneo reserves the right to cancel or reschedule any tour departure for any reason, force majeure (see Force Majeure section). If a tour is canceled prior to departure, Indoneo only responsibility will be to refund the amount received for the reservation. Indoneo will try to rebook the same tour with a different departure date, or a similar tour but there is no guarantee of availability of offering. Indoneo cannot assume responsibility for any additional costs or any fees related to the issuance and/or cancellation of air tickets or other travel arrangements not made through Indoneo.
REFUNDS
Any request for refunds is subject to these Terms Of Service; no refund will be made for unused services, for unused transportation or for voluntary modifications made by the Traveler. Changes made at your discretion to tour features, timings, or tour services (e.g. meals, included sightseeing, etc…) are not refundable nor exchangeable for other services.
PHOTOS, VIDEOS AND MARKETING
You consent to us using images and videos of you taken during the tour for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.
PRIVACY POLICY
Any personal information that we collect about you may be used for any purpose associated with the operation of a tour or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the tour.
LEGAL NOTICES
Entering into this agreement, you accept that any disputes arising will be interpreted in accordance with the laws of the Republic of Indonesia. Any dispute will be discussed internally between both parties, but should a legal action is required, both parties agree to choose Yogyakarta as the place for any arbitration. If for any reason, any part of this agreement if totally or partially invalid, the remaining provisions of this document remain valid and binding. Any special arrangement and/or requirements should be discussed separately and attached to this contract and/or in the form of an addendum.
